Terms & Conditions
Last updated October 13, 2026These terms govern your use of anine.agency and the services provided by Anine® Agency. By using our website, or by engaging us for a project, you agree to these terms. A signed proposal or project agreement may add to them, and where the two conflict, the project agreement applies.
Acceptance of Terms
By accessing our website or requesting our services, you confirm that you have read, understood and agree to these terms. If you do not agree, please do not use our website or services.
Our Services
We provide brand strategy, brand and digital (visual identity, websites and online stores), growth and marketing, and ongoing digital support. The exact scope of each project is described in your proposal.
Proposals and Scope
Each project begins with a written proposal that sets out the scope, deliverables, timeline and fees. Work outside the agreed scope is quoted separately and begins only after you approve it in writing.
Your Responsibilities
To keep your project on schedule, you agree to:
- Provide accurate information, content, images and brand assets on time.
- Give feedback and approvals within the timeframes agreed.
- Confirm that you own, or have permission to use, all materials you supply to us.
- Pay fees according to our Payment Terms.
Delays in providing materials or feedback may move the project timeline.
Revisions and Approvals
Your proposal states the number of revision rounds included for each stage. Additional rounds, or changes after a stage has been approved, may be charged. Approval of a stage lets us move to the next one.
Intellectual Property and Ownership
Once all fees for a project are paid in full, ownership of the final approved deliverables transfers to you. Until then, we keep ownership of all work. We keep ownership of our working files, methods, tools and any pre-existing materials, and we license these to you as needed to use the deliverables.
- Third-party assets such as fonts, stock images and plugins remain subject to their own licenses.
- Unless you tell us otherwise in writing, we may show the finished work, with your brand name, in our portfolio, case studies and marketing.
Confidentiality
We treat non-public information you share with us as confidential, use it only to deliver your project, and do not share it with other clients or unrelated third parties, except with service providers who need it to help deliver the work.
Third-Party Tools and Platforms
Our work often depends on third-party platforms such as hosting providers, website builders, payment processors and advertising platforms. These providers have their own terms and policies, and we are not responsible for changes, outages or decisions made by them.
Marketing and Advertising Results
We use professional judgment and proven methods in advertising, content and growth work, but we cannot guarantee specific results such as traffic, leads, sales, rankings or return on ad spend. Results depend on many factors outside our control, including your market, offer, budget and the platforms themselves.
Disclaimer of Warranties
Our website and materials are provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in your project agreement.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses, including lost profits or lost data. Our total liability for any claim relating to a project is limited to the fees you paid us for that project.
Cancellation and Termination
Either party may end a project by written notice. You remain responsible for fees for work completed and costs incurred up to the date of termination, as set out in our Payment Terms. We may pause or end work if payments are overdue or if the project cannot continue because required materials or approvals are not provided.
Governing Law
These terms are governed by the laws of the jurisdiction in which Anine® Agency is established. Both parties will first try to resolve any dispute in good faith through discussion before taking formal action.
Changes to These Terms
We may update these terms from time to time. The updated version applies from the date shown at the top of this page. Existing project agreements are not changed unless both parties agree.
